That's why Trademark law is all about letting the consumer know who is responsible for what. IF the original appearance had been trademarked -- and not allowed to lapse after 10 years -- somebody at RW would be in trouble. But if that stuff wasn't trademarked (or had been but the 10 years of rights had run its course and not been renewed) then it's open for use by anyone. And apparently "anyone" did.
