Terms of Service:
The following terms and conditions govern all use of the Elvastower.com website and all content, services and products available at or through the website, including, but not limited to, forums, private messaging, downloadable "freeware" content, and downloadable "payware" content, (taken together, The Website). The Website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, The Website Privacy Policy and procedures that may be published from time to time on this Site by the owners and assignees of Elvastower.com (collectively, The Staff)). These terms of service are, collectively taken together as The Agreement.

Please read this document --The Agreement-- carefully before accessing or using The Website. By accessing or using any part of The Website, you agree to become bound by the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, then you are not authorized to logon and may not access The Website or use any services. If these terms and conditions are considered an offer by The Staff, acceptance is expressly limited to these terms.


THE PURPOSE AND TERMS USED BY THE WEBSITE
The purpose of The Website is the exchange of information of text or images (collectively Content) between members, typically in serial, conversational style. Definitions:



  • Content are referred to as Posts and the act of submitted Content to The Website is Posting.

  • The first post of any topic is referred to as The Basenote.

  • The Basenote and all subsequent replies are referred to as a Thread.

  • Threads intended to be read by all members are collected in general categories of subjects called Forums.

  • Threads intended for private conversation between a few members are called Private Messages and/or PM's.





1. MEMBERSHIP
Membership at The Website is an allowed privilege, not a right.


  • You agree that membership at The Website exists at the sole discretion of The Staff. It may be terminated at any time for any reason and done so without any explanation.

  • Only members may post or download.

  • You agree that posting privileges may be revoked for a period of time by The Staff at the sole discretion of The Staff.

  • You agree that downloading privileges may be revoked for a period of time by The Staff at the sole discretion of The Staff.

  • You agree that termination of membership by the staff is applied to the person as well as account that person uses to log on to The Website. YOU will no longer be authorized to log on to The Website under any account.





2. POSTING
The Website makes no claims of ownership of your Content: Your words and images are are always copyrighted to you and you are fully responsible for them. However, with respect to Content you submit or make available for inclusion on publicly accessible areas of the Website, you MUST make specific grants to The Website and it's members as follows:

By using The Website to post your words and images you make the following grants:


  • You irrevocably license The Website to post your Content worldwide, royalty-free, under a non-exclusive license solely for the purposes of providing and promoting the specific Forum(s) to which such Content was submitted or made available.

  • You irrevocably grant Staff the right to move your content from one forum to another if it is felt the Content is more better suited to the purpose of the destination Forum.

  • You irrevocably license all members of The Website to quote your text in whole or part at The Website as Fair Use of your words.

  • When quoting another member you agree such quoting occurs only in the forums hosted at The Website.

  • When quoting another member you agree to limit your edits of that quote to deletions for purpose of brevity and/or minor spelling and punctuation corrections.

  • You irrevocably license The Website to make all decisions regarding deletion of your posts.

  • You irrevocably license The Website to make any edits to your posts for purposes of maintaining a civil manner within the forums.


You may at any time request your posts to be deleted but the decision to do so is entirely up to The Staff.


What this means in plain language: You own your Content and are responsible for what is says or shows. You may always make your Content available elsewhere. By posting it at The Website you allow the Website and Members to read and quote your content without restriction and do so for as long as The Website chooses.




3. YOUR BEHAVIOR ON THE WEBSITE WHEN POSTING
To ensure The Website can function in a civil manner you are expected to behave as if you are at another persons house, a store, or a library... someplace where gross misbehavior is inappropriate and cannot be tolerated. Therefore, you agree:


  • You will not write posts abusing the character, ethnicity, or core beliefs (e.g., political, religious, sexual) of other members (a good joke about yourself might be overlooked).

  • You will not post profanity.



What this means in plain language: Be careful about what you write and be polite. You may not force anyone to delete or edit a quotation of yours so long as the quotation itself is entirely your words. If you are quoting someone you may make minor edits but you cannot edit for the purpose of "putting words into somebodies mouth". Last, ALL decisions on enforcing these terms are the sole decision of The Staff -- you may always ask for something but the decision belongs to The Website.


In return, the The Staff will endeavor to return your respectful behavior in kind:




  • The Staff comments in posts will be identified as such.

  • The Staff editing of your posts will be identified and a reason for such edits provided so all can read why the edit was performed.

  • The Staff efforts to pull a thread away from the edge of impolite / argumentative course will instruct all on what is going wrong and what is expected. The thread will remain open under those terms but may be locked if in subsequent posts the expected behavior is not met.

  • The Staff may make note of thread drift by suggesting a thread split but will otherwise allow the conversation to run it's own course.



What this means in plain language is you have to be very well behaved and so long as that is the case The Staff will refrain from interfering with your conversations. You must refrain from talking about national politics, religion, sexuality, and ethnicity in any way that might be construed by any reader to be offensive. This does not mean you cannot write about yourself or nominal secular events, so it is okay to say you are of a particular faith, political persuasion, etc., that you had fun at a St. Patrick's day parade, etc. etc., but you may not originate or respond in any way whatsoever that casts an unfavorable light upon those subjects. As an example, you may not write I believe in X when it is generally understood that even raising the topic of X is offensive to some readers.




4. COMPLIANCE with the the DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA)

You agree to comply with the DMCA of the United States, specifically:




  • You will not post copyrighted video, audio, photograph, or text owned by another person to any forum of file library of this board EXCEPT as noted below under EXCEPTIONS.

  • You will not post about your non-compliance with the DMCA outside of The Website.

  • You will not file DMCA Take Down requests of your own Content because you have already irrevocably granted the right to edit and quote them to The Website and its members.


EXCEPTIONS


  • You may post a link to any copyrighted work when you believe the target of the link is the rightful owner of that work.

  • You may quote a small portion of another persons copyrighted work that is located outside of The Website solely for purpose of discussion as defined by the "Fair Use" provisions of US Copyright Law.

  • You may quote other members of The Website in full so long as you conform to the terms of The Agreement



What this means in plain language is that this site is not intended to host stolen works. The exceptions are for very small portions of a work that serve entirely for the purpose of a required context for further discussion. For example: If you need to use another persons photo to provide context you must crop away a considerable majority of the whole image thereby making the residual amount the sole context for discussion. So if you want to ask about a locomotive you only should provide enough of the photo to support your question / answer and no more. In most cases a link to the original work will be an acceptable alternative but remember that doing so will always leave a risk the photo is taken down at some later time making your post devoid of context, so it is preferred that you crop and post.




5. CHANGES TO THE AGREEMENT
We are constantly updating our services, and that means sometimes we have to change the legal terms under which our services are offered. If we make changes that are material, we will let you know by posting in our Announcement Forum, or by sending you an email or other communication before the changes take effect. The notice will designate a reasonable period of time after which the new Terms will take effect. If you disagree with our changes, then you should stop using The Website within the designated notice period. Your continued use of The Website will be subject to the new Terms. However, any dispute that arose before the changes shall be governed by the Terms (including the binding individual arbitration clause) that were in place when the dispute arose.




6. TERMINATION OF MEMBERSHIP
Staff may terminate your access to all or any part of The Website at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your membership, you may simply discontinue using The Website. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, grants by you, ownership provisions, warranty disclaimers, indemnity and limitations of liability.




7. DISCLAIMER OF WARRANTIES
The Website is provided “as is”. Owners and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Owners nor its suppliers and licensors, makes any warranty that the Website will be error free or that access thereto will be continuous or uninterrupted. If you’re actually reading this, here’s a treat. You understand that you download from, or otherwise obtain content or services through, the Website at your own discretion and risk.



8. LIMITATION OF LIABILITY
In no event will The Website, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by you to The Website under this agreement during the twelve (12) month period prior to the cause of action. The Website shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.




9. INDEMNIFICATION
You agree to indemnify and hold harmless The Owners, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of The Website, including but not limited to your violation of this Agreement.
